General Terms and Conditions

Article 1: Scope of Validity

  • The primary goal of GlamNXT is to match supply and demand, enabling individuals and companies (hereinafter "CLIENT") to hire registered beauty professionals (hereinafter "PROFESSIONAL") via the website GlamNXT.nl (hereinafter "PLATFORM") for the performance of work (hereinafter "WORK"). The use of our PLATFORM and other services of GlamNXT is solely in accordance with these General Terms and Conditions.
  • Deviations from these General Terms and Conditions must be expressly permitted by GlamNXT.
  • Unless otherwise agreed, the General Terms and Conditions in the version valid at the time of registration by the PROFESSIONAL, or in the most recently known written version, serve as the legal framework for facilitating (further) agreements between PROFESSIONAL and CLIENT.

Article 2: Subject of the Agreement

  • PROFESSIONAL is registered with the Chamber of Commerce.
  • These General Terms and Conditions apply to the ongoing use of facilities provided by GlamNXT for the conclusion of agreements between PROFESSIONAL and CLIENT regarding the performance of WORK and the commercial handling of such agreements between CLIENT and PROFESSIONAL by GlamNXT.
  • No agreement for WORK is concluded between GlamNXT and the PROFESSIONAL, nor between GlamNXT and the CLIENT at the request of the PROFESSIONAL. By confirming a work request, the PROFESSIONAL concludes an agreement with the CLIENT.
  • GlamNXT facilitates the conclusion of an agreement for WORK between PROFESSIONAL and the CLIENT on behalf of the PROFESSIONAL. GlamNXT, however, does not facilitate or handle payments. The PROFESSIONAL is responsible for collecting payments directly from the CLIENT.
  • Payments for WORK are handled directly between the CLIENT and the PROFESSIONAL. GlamNXT does not facilitate payment transactions. The PROFESSIONAL must ensure they collect payment directly from the CLIENT.
  • GlamNXT verifies registration and confirms this to the PROFESSIONAL by email, indicating that the full user account can be used to receive work requests. At that moment, the user agreement between GlamNXT and PROFESSIONAL is concluded, to which these General Terms and Conditions apply.
  • The PROFESSIONAL authorizes GlamNXT, by concluding the user agreement, to act as a representative with the authority to conclude agreements on behalf of the PROFESSIONAL and to represent the PROFESSIONAL towards the CLIENT. Additionally, the PROFESSIONAL agrees to share the data needed for payment transactions with GlamNXT, although GlamNXT does not handle actual payment transactions.
  • GlamNXT reserves the right to charge a commission on orders when GlamNXT begins to facilitate payments. In that case, GlamNXT will notify the PROFESSIONAL 30 days in advance by email before commission charges are implemented.

Article 3: Facilitation

  • GlamNXT receives service requests from CLIENTS via the PLATFORM, the GlamNXT app, phone, SMS, or email and sorts these requests by location, time, and required activities.
  • GlamNXT facilitates the CLIENT's request and automatically searches for suitable beauty PROFESSIONALS, forwarding the service request (usually by email, SMS, via the GlamNXT portal, GlamNXT app, or by phone).
  • The PROFESSIONAL informs GlamNXT via the platform, app, phone, SMS, or email if they accept a service request from a CLIENT. If a PROFESSIONAL accepts the service request, it is blocked for other professionals.
  • GlamNXT accepts the CLIENT's offer on behalf of the first PROFESSIONAL who has accepted the service request and confirms the order by email. This concludes an agreement for WORK between PROFESSIONAL and CLIENT.

Article 4: Other Obligations of GlamNXT

  • GlamNXT is obligated to: Manage the PLATFORM and offer the services of PROFESSIONALS with the specialties and locations indicated by them; Manage a user account for PROFESSIONALS where agreements for WORK can be viewed; Forward appropriate work requests from CLIENT to the PROFESSIONAL based on their specialties and location; Accept job applications on behalf of the PROFESSIONAL.
  • GlamNXT prepares invoices for the performed WORK based on data entered by the PROFESSIONAL and sends them to the CLIENT.
  • GlamNXT processes bookings and cancellations by the CLIENT (GlamNXT may charge its own cancellation fees). If the CLIENT wants to change or cancel an appointment, GlamNXT will promptly inform the PROFESSIONAL by SMS, email, push notification, or phone.
  • GlamNXT receives complaints from CLIENTS and forwards them to the PROFESSIONAL, who can review and resolve them. The PROFESSIONAL must inform GlamNXT if an invoice should not be sent due to complaints or if a credit note is needed. GlamNXT may offer CLIENTS an appropriate solution and pass these costs on to the PROFESSIONAL, who will be informed in advance by email, SMS, or phone.

Article 5: Obligations of the Professional

Upon registration on the PLATFORM, the PROFESSIONAL must provide the following data/documents to GlamNXT: Valid name and address details (company name, first name, last name, company address, Chamber of Commerce, and VAT number); Specialties and locations of the offered work; Email address, phone number; Valid and complete bank details. GlamNXT has the right to request references about the PROFESSIONAL's work from former clients. In case of changes to the provided information, the PROFESSIONAL must immediately inform GlamNXT. The PROFESSIONAL acknowledges that work requests cannot be forwarded without the requested data and documents. After each job obtained via the GlamNXT PLATFORM, the PROFESSIONAL will create an invoice for the performed WORK in the GlamNXT application. Since the PROFESSIONAL is not an employee of GlamNXT, they are responsible for the correct payment of taxes and contributions and for obtaining disability insurance. The PROFESSIONAL must have liability insurance with adequate coverage when accepting a job. The PROFESSIONAL is not obligated to accept work requests but authorizes GlamNXT to accept work requests and handle necessary statements for the execution of the assignment according to their instructions. The PROFESSIONAL must inform GlamNXT via the platform or by phone about changes concerning already booked work, especially if delays are expected, so GlamNXT can timely inform the CLIENT.

Article 6: Liability

GlamNXT is not liable for the execution of the agreement for WORK by the PROFESSIONAL and/or the CLIENT. The pages on the GlamNXT website contain links to websites operated by third parties. GlamNXT is not responsible for the content of these websites and provides links only for convenience. For the execution of agreements with CLIENT and/or user agreements with GlamNXT, the PROFESSIONAL expressly agrees not to enter into an employment contract with GlamNXT. The content of the agreement for WORK is determined between PROFESSIONAL and CLIENT.

Article 7: Termination

The user agreement, to which these General Terms and Conditions apply, is for an indefinite period and can be terminated by both parties at any time with immediate effect. Termination must be in writing; email communication is sufficient. If GlamNXT terminates the user agreement due to circumstances attributable to the PROFESSIONAL, GlamNXT may cancel any remaining bookings or agreements on behalf of the PROFESSIONAL with the CLIENT. If the PROFESSIONAL terminates the user agreement for any reason, GlamNXT has the right to immediately terminate agreements for ongoing and unperformed bookings on behalf of the PROFESSIONAL and inform the CLIENT. GlamNXT may stop sending work requests to the PROFESSIONAL if they have not accepted any work requests for more than a month. The PROFESSIONAL may request a resumption of work requests at any time. GlamNXT may also stop sending work requests to the PROFESSIONAL if: A CLIENT has complained multiple times about the PROFESSIONAL's work; The average CLIENT ratings for the PROFESSIONAL fall below GlamNXT's standard of 3.5 stars on a 5-star system; The PROFESSIONAL does not adhere to these General Terms and Conditions; Other unacceptable circumstances, as assessed by GlamNXT.

Article 8: Final Provisions

  • The PROFESSIONAL may not transfer their rights and obligations to third parties without prior written consent from GlamNXT.
  • Dutch law governs these General Terms and Conditions and all agreements between the PROFESSIONAL and GlamNXT.

Article 10: Amendments

  • GlamNXT reserves the right to amend these General Terms and Conditions at any time. The PROFESSIONAL will be informed of any amendments by email or through the PLATFORM.
  • Amendments take effect 30 days after notification unless otherwise specified.

Article 11: Special Conditions

  • Special conditions applicable to certain types of WORK or specific agreements will be agreed upon in writing and take precedence over these General Terms and Conditions.
  • If a provision of these General Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
    • Special conditions will be communicated separately and must be acknowledged by the PROFESSIONAL.
    • Any changes to the special conditions must be documented and confirmed by both parties.
    • GlamNXT may introduce new special conditions as needed, with prior notice to the PROFESSIONAL.

Article 12: Data Protection

GlamNXT ensures that all personal data of the PROFESSIONAL is handled according to applicable data protection laws. The PROFESSIONAL's data will only be used for the purposes of facilitating and managing work requests and will not be shared with third parties without consent, except as required by law.

Article 13: Miscellaneous

  • These General Terms and Conditions constitute the entire agreement between the PROFESSIONAL and GlamNXT concerning the use of the PLATFORM.
  • No verbal agreements or statements made by GlamNXT representatives shall alter these General Terms and Conditions.
